Determination of Development Conditions
Depending on the type of investment, either a notification is submitted or a building permit is obtained, which differs primarily in the duration of the process and the scope of required documents. Obtaining a decision on development conditions (WZ) is usually necessary to begin construction. A project context in which a given plot is not included in the Local Spatial Development Plan (MPZP) provides the basis for applying for a decision on development conditions. This document is issued by a decision of the relevant administrative body upon request. It is not necessary to be the plot owner, although only the owner can obtain the decision free of charge.
Administrative Authority
The first step is to identify the appropriate architectural and construction authority issuing the decision on development conditions; this may be the district head, city mayor, or, in some cases, the voivode. In the case of a city hall, the urban planning department may be located in a separate location from the main office.
Base Map Next
A base map must be obtained. A base map at a scale of 1:500 or 1:1000 is available from the district office's surveying department. The base map should cover an area of at least three widths of the plot frontage, with a minimum of 50 meters and a maximum of 200 meters. The cost of such a map ranges from several dozen to several hundred zlotys, depending on the size of the area and the chosen version of data submission: paper or electronic.
Application for Development Conditions
The application for development conditions must be completed and the area covered by the application must be marked on the base map. If a property deed is available, it is worth considering initiating the process of obtaining technical specifications for electrical, water, and other connections.
In principle, a Development Conditions Decision is general in nature, but the administrative body has the right to freely define the boundary conditions that will allow for the construction of a given development. The content of the application is a key element determining the parameters of the issued decision. Therefore, it is important to remember that all values defining the planned development should be included in the application, with the greatest possible margin for possible corrections during the design process after receiving a positive administrative decision.
Table of characteristic building parameters. The designed minimum and maximum values should be within +/- 20% of the characteristic (anticipated) values of the designed building. The best solution is to supplement the required information about the planned construction project so that the range is as wide as possible, and the values defining the building are within the specified minimum and maximum values.
The same principle applies to biologically active surface area. In the context of single-family housing, the biologically active surface area should be at least 20% of the total site area. In the case of multi-family housing, healthcare, or education, the minimum indicator is 25%. The maximum value is the total site area minus the building area. It is important to maintain a margin of safety in the event of changes to plans during the design process or a different opinion from the administrative body regarding the inclusion of certain building elements in the calculation of urban development coefficients. It is worth bearing in mind that the changed value of the paved area of a given plot at a later date is not subject to the administrative procedures of notification or building permit for a building structure.
Area subject to transformation. According to the regulations, the application must be supplemented by providing the area of the land where the change of use will be made in accordance with spatial planning regulations – for example, the area of land designated as R (agricultural land), Ł (meadow), or Ls (forest land), whose function will be changed to B (building land). Land maps indicate the land classification with a dashed line, so a given plot does not always fall within an area exclusively designated for single use. The minimum area subject to transformation is equal to the sum of the building area and the paved areas designated, for example, for a garbage can. The maximum area subject to transformation may include the entire plot, unless it is already a building plot.
Graphic Section and Impact Area of the Development Conditions Application
A graphic section should also be attached to the completed application. The Spatial Planning and Development Act (Journal of Laws of 2003, No. 80, item 717 - UPZP) defines the scope of the development conditions application in Article 52.
The graphic section should define the boundaries of the area covered by the application, presented on a copy of the base map or, in the absence thereof, on a copy of the cadastral map covering the area covered by the application and the area affected by the investment. Map scale: 1:500 or 1:0000. The provision regarding the potential environmental impact of the investment is somewhat enigmatic, especially since the section also concerns the decision on the location of a public purpose investment. In the case of a single-family home, this may be limited to designating the investment area. If the single-family home is located no closer than 4 meters from the property line and the application does not include a wastewater tank, the impact area can be stated as being entirely within the development plot. Otherwise, the impact area includes adjacent building plots.
The area where development is planned constitutes the investment site. Area factors in the planning permission issued by the administrative authority, such as biologically active area and maximum building area, apply to the given area. It is not necessary for the investment site to coincide with the boundaries of the building plots. It may constitute a portion of the plot, run through multiple plots, or intersect their boundaries. The investment site provides the most important information for the official regarding the application. Therefore, it is mandatory to mark it in an appendix to the application for a development permission.
The frontage of the plot refers to the plot boundary from the side of the access road to the subject plot. The location of the access road to the plot must be specified in the application and in the graphical appendix. This boundary constitutes the "front" part of the plot, and it is to this side of the plot that parameters such as the width of the front façade and the building line refer.
The building line or depending on the context - building limit is the boundary defining the shortest distance from the front of the plot at which development is permitted. The main body of the building cannot cross this line. It does not apply to elements such as balconies, canopies, eaves, or even avant-corps. The mandatory building line is a special case. In the case of the mandatory line, the edge of the main building must lie exactly on the line.
The main ridge is the highest horizontal edge of the roof, the point where the roof slopes intersect, most visible on gable roofs. In the case of hipped or multi-pitched roofs, it may be very short or may be absent altogether (in cases where the corners between the four roof slopes meet at a single point, the ridge is a point).
The height of the top edge of the front facade, its cornice, or parapet – this refers to the height from ground level to the eaves if the eaves are at the front, or to the gable end of the building if it has a flat roof or is oriented with its gable end toward the edge of the plot from which the access is provided. This should not be confused with the building height, which is usually greater. In the case of a building with its eaves along the front of the plot, this height can be determined, for example, from a cross-section available in a .pdf file. It is worth noting that, according to the law, the height is calculated from the average ground level next to the building. This typically means the average of the lowest and highest points directly adjacent to the planned structure.
That can be significant in the case of steeply sloped plots. Important! If the building is positioned with its gable end facing the front of the plot, the height of the front facade is equal to the height of the building on that side.
Documents Submission
The prepared documents should be submitted to the appropriate office designated for the given area to issue development decisions, i.e., the commune head, mayor, or city president. The office issues the development decision to the plot owner free of charge.
Obtaining Permit Approval
Before issuing a zoning decision, the relevant authority conducts an urban planning analysis. This means that the building's maximum dimensions must be determined in relation to existing buildings, which are drawn on the map attached to the application. These buildings must also be located on the same street from which the access to the area specified in the application is accessible. It should be noted that a map coverage slightly larger than the minimum is recommended in this case, especially if the buildings not directly adjacent to the plot in question have design parameters that meet the investor's expectations, such as building density, building distance from the road, roof shape, etc.
The urban planning analysis procedure allows officials discretion in assessing the design situation. In practice, the official may agree to accommodate buildings located further away from the plot. Much depends on the design context.
Application Processing
Period 21 days – if it concerns a detached, two-story, single-family residential building with a building area of up to 70 m², whose impact area is entirely within the plot or plots on which it was designed, and the construction is carried out to meet the investor's housing needs;
65 days – if it concerns an agricultural biogas plant meeting certain requirements;
90 days – in other cases.
In practice, this deadline may be longer, as it does not include the deadlines for obtaining agreements and opinions or suspension periods. The issuance of a decision may also be delayed, for example, due to the fault of a party or reasons beyond the authority's control.
The deadline will be interrupted if the office identifies deficiencies in the application and while awaiting possible agreements from other offices (they usually have two weeks to do so).
The authority may suspend the proceedings in the event of the preparation of a local development plan for the area covered by the application. The proceedings may be suspended for a maximum of 18 months from the date of submission of the application.
Changing a Development Decision
If the issued development decision does not meet the investor's expectations or if their expectations have changed, a new development decision should be submitted.
It's also worth remembering an important detail: the finality of the decision. The decision becomes final immediately upon its issuance, only if there are no parties to the proceedings. A decision without a stamp confirming its finality and finality has no legal force and is not recognized by the office issuing the building permit. Therefore, before applying for a building permit, it is advisable to obtain the final decision. This also applies to other administrative decisions that may be optionally attached to the application.
